Constitutional Assembly Debates
The constitution of India has been drafted by the constituent assembly. The debates and discussion which led to the formulation of original provisions/ texts of the Constitution of India is a public document. It is a treasure trove of wisdom, ideas and the key to the mind of statesman drafting a constitution for a republic as diverse as India.
These debates are important to understand the intent, original purpose and what remedy the constitution makers sought to address while adopting a key constitutional provision. It is much like ‘The Federalist Papers’ which were foundational texts and exchange of ideas between the draftsmen of US Constitution. The constitutional courts in India have used CADs as an interpretative tool to resolve and answer key constitutional issues in appropriate cases. Our law reports are full with such instances. Hence, this section is exclusively devoted to such foundational debates and documents which have shaped the Indian constitutionalism.
